How to Hire Foreign Workers in Malaysia: A Step-by-Step Overview

1) dOCUMENTATION
PREPARATION

  • Check your industry whether is  eligible to apply for foreign worker quota.

  • Prepare company statutory documents, business council license, current staff listing, tenancy agreements and any relevant approvals.

2) Apply for Section 60K Approval (Employment Act 1955)

Apply via the ePPAx system under the Employment Act 1955. 

3) Apply for Quota APPROVAL FROM KDN

Submit your foreign worker quota request to the One Stop Centre (KDN) for legal recruitment approval.

4) levy payment
to immigration

Arrange for payment on levy payments to the Immigration Department based on worker nationality and sector rates.

LEVY PAYMENT

5) OBTAIN Certificate
of Good Conduct (SKB)

  • Apply for the Certificate of Good Conduct (SKB) through the Ministry of Foreign Affairs' website which is a prerequisite for hiring foreign workers in Malaysia after quota approval.

6) IMMIGRATION APPROVAL

Submit for calling visa approval, FOMEMA medical screenings, arrange clearance of workers upon arrived in Malaysia.

7) Issuance of Temporary Employment Pass (ePLKS)

Once FOMEMA medical screenings are cleared, to obtain Temporary Employment Pass (Pas Lawatan Kerja Sementara – ePLKS) to legalizes the worker’s employment in Malaysia.

8)Worker Welfare & Accommodation Compliance

To provide housing, welfare, and working conditions comply with the Workers’ Minimum Standards of Housing and Amenities Act 446 and other related laws.
